Warranty Information Image Products, Inc. (“Image”) makes the following warranties with respect to products ordered from this website by the holder of points (“participant”): A. For electronics products, Image warrants to the original ordering participant that the product ordered by the original ordering participant will be free from defects in material and workmanship under normal use for the lifetime of the product as long as owned and used by the original ordering participant. B. For products other than electronics, Image warrants to the original ordering participant that the product ordered by the original ordering participant will be free from defects in material and workmanship under normal use for a period of one hundred eighty (180) days from the date of shipment or purchase by the original ordering participant. If one or more of the above identified products is determined to be defective during the applicable warranty period, Image’s liability shall be limited to the repair or replacement of this product with a new or similar product at Image’s option. You must follow the instructions given in the Points Program Terms and Conditions for warranty service. THIS WARRANTY SHALL NOT APPLY IF THE PRODUCT: (I) IS USED WITH PRODUCTS NOT SOLD OR LICENSED BY IMAGE (INCLUDING, BUT NOT LIMITED TO, ADAPTORS AND POWER SUPPLY DEVICES) OR OTHERWISE NOT COMPATIBLE WITH THE PRODUCT; (II) IS USED FOR COMMERCIAL PURPOSES (INCLUDING RENTAL) OR IS MODIFIED OR TAMPERED WITH; (III) IS DAMAGED BY ACTS OF GOD, MISUSE, ABUSE, NEGLIGENCE, ACCIDENT, WEAR AND TEAR, NEGLECT, UNREASONABLE USE, OR BY OTHER CAUSES UNRELATED TO DEFECTIVE MATERIALS OR WORKMANSHIP; OR (IV) HAS HAD THE SERIAL NUMBER ALTERED, DEFACED OR REMOVED. THIS WARRANTY DOES NOT COVER PRODUCTS SOLD AS IS OR WITH ALL FAULTS, OR CONSUMABLES (SUCH AS BATTERIES). PROOF OF PURCHASE WHICH IS EVIDENCE THAT THE UNIT IS WITHIN THE WARRANTY PERIOD MUST BE PRESENTED TO OBTAIN WARRANTY SERVICE. REPAIR OR REPLACEMENT AS PROVIDED UNDER THIS WARRANTY IS THE EXCLUSIVE REMEDY OF THE PARTICIPANT. IMAGE DISCLAIMS ANY AND ALL EXPRESS AND IMPLIED WARRANTIES NOT EXPRESSLY MADE IN WRITING, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. IMAGE SHALL NOT BE LIABLE OR RESPONSIBLE FOR THOSE GUARANTEES, WARRANTIES AND REPRESENTATIONS, IF ANY, OFFERED BY POINTS PROGRAM SUPPLIERS OR SERVICE PROVIDERS. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY A PARTICIPANT FROM IMAGE THROUGH THE POINTS PROGRAM SHALL CREATE ANY WARRANTY NOT EXPRESSLY MADE HEREIN. IMAGE SHALL NOT BE LIABLE FOR ANY DAMAGES, WHETHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL, RELATING TO THE POINTS PROGRAM, THE PRODUCTS FOR WHICH POINTS ARE REDEEMED, OR ANY CONSEQUENCES FLOWING THEREFROM OR RELATED THERETO. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES; SO THE ABOVE LIMITATION OR EXCLUSION MIGHT NOT APPLY TO YOU.
